Do you Have a case? Call Today! 415-404-6395

We have the right to safe products. Whether we are purchasing a toy for our child or a vehicle for our everyday commute, we should never have to wonder whether or not it is safe. When the negligence of a company or manufacturer causes harm, they need to be held accountable. Today, we are going to discuss a state Supreme Court ruling that does just that.

At Allegiance Law, we are here when you need a San Francisco product liability attorney. We will work diligently to secure the compensation you deserve.

Nissan Is Denied

We have learned that the California Supreme Court has denied a petition by Nissan to appeal a $25 million verdict against them over faulty brakes.

The case in question revolved around Cory Watson whose Nissan was involved in a crash that killed three people and led to a wrongful manslaughter charge. A Los Angeles jury ruled in July 2017 that Nissan should be held accountable for faulty brakes in the case.

The $25 million verdicts that Nissan tried to appeal is the largest ever against them regarding a brake defect case.

The decision by the state Supreme Court upheld a lower court’s findings and is the final say in the case.

What Can Happen?

Have you ever really checked to see if you own any defective products?

Do you know how to find out?

There is a government website that tracks all current recalls in the United States. If you go there, you may be surprised by the number of recalls that are continually ongoing. They span every industry and show us that faulty products make it to the market each day despite regulations in place to prevent them.

This website only shows part of the picture though. Products that make it to recall status are the ones in which a problem has been discovered. There are many more out there that we do not yet know about.

How do our everyday products become defective?

Usually, we can narrow these issues down to one of three things:

  1. There is a problem with the product’s design that causes them to be harmful to consumers.
  2. They experience a manufacturing error that alters them from their original design.
  3. There is a problem with the labeling that misleads the consumer about ingredients, dosages, hazards, instructions, etc.

What Happens Now?

We all deserve safe products and the regulations in place should provide us with them. However, we know that the negligent and careless actions of companies and manufacturers often allows defective products to hit the market. At Allegiance Law, we are going to be by your side if you or a loved one are injured.

Let us work to secure the compensation you deserve, including:

  • Coverage of medical expenses
  • Recovery of lost wages if you cannot work
  • Pain and suffering damages
  • Loss of enjoyment of life damages
  • Punitive damages against the company or manufacturer
