The driver of the vehicle was a 24-year-old man who was brought to the hospital with minimal injuries. According to court documents, when his blood alcohol was tested, the results were .206, severely over the .08 percent legal limit. The driver has been charged with murder because of his suspended license from a DUI incident in December 2018. Because of the Watson ruling, his decision to drive while intoxicated allowed him to be liable for murder under an implied malice theory. He is currently being held without bail in the Santa Clara Country Main Jail.
