Drunk driving accidents lead to immense tragedy and loss for the victims. As it turns out, these accidents are becoming more and more common throughout the San Francisco area. Here at Allegiance Law, our San Francisco drunk driving accident lawyers want to discuss a recent drunk driving accident that took four San Jose residents’ lives. This terrible and avoidable incident caused unimaginable grief and showed how much harm drunk driving can cause.
On May 14, 2020, a driver struck and killed four adults in Santa Clara county. The accident happened at 10:15 PM, and because of the high-speed collision, three of the victims were thrown from the vehicle and died at the scene. The fourth person died from injuries at the hospital.
The driver of the vehicle was a 24-year-old man who was brought to the hospital with minimal injuries. According to court documents, when his blood alcohol was tested, the results were .206, severely over the .08 percent legal limit. The driver has been charged with murder because of his suspended license from a DUI incident in December 2018. Because of the Watson ruling, his decision to drive while intoxicated allowed him to be liable for murder under an implied malice theory. He is currently being held without bail in the Santa Clara Country Main Jail.
This incident is still under investigation by the San Francisco Police Department.
The reality is that pedestrian accidents are not uncommon in this area. They are often caused by other drivers’ careless or reckless actions, similar to the case above. Our San Francisco pedestrian accident attorneys at Allegiance Law find that drivers fail to respect pedestrian right-of-way laws. This can lead to drivers striking pedestrians in marked crosswalks. Of particular concern for pedestrians in San Francisco are drivers who are impaired by alcohol or drugs or distracted by their cell phones or other devices.
Drunk driving accidents are something no one can prepare for, but they are far too familiar in this area, and they are caused by people being irresponsible and malicious, as in the case above. Here at Allegiance Law, our San Francisco drunk driving accident attorneys find that drivers fail to understand the impact a “couple of drinks” make and therefore drive while severely impaired. Holidays that are full of celebration instead are filled with grief and heartache.
According to the California Office of Traffic Safety, 30% of all vehicle-related deaths involve alcohol as well as countless injuries.
Those who survive drunk driving accidents often sustain severe injuries, including:
